Terms of use (pilot)
These terms apply to your use of Nine Firm, a service for estimating the reliability and cost of power supply for datacenters, provided by [Nine Firm legal entity name, e.g. Nine Firm LLC] ("we", "us"). By signing in or using the service you agree to them on behalf of yourself and the organization you represent.
1. The pilot
The service is currently offered as a pilot. Features, limits and availability may change, and we may suspend or end access at any time with reasonable notice where we can give it. There is no charge during the pilot. If we introduce fees, they will be agreed with you separately before they apply.
2. Accounts and access
Who can sign in, and with what role, is set by invitation or by an access code that we issue on your organization's behalf; your organization's administrator can ask us to add or remove people. Keep your sign-in credentials private, do not share accounts, and tell us promptly at contact@ninefirm.com if you think an account has been compromised. You are responsible for activity under your organization's accounts.
3. Your data
You keep ownership of the inputs you enter, the projects you save and the results produced for you ("your data"). You give us permission to store and process your data only as needed to provide, secure and support the service. We do not sell your data, and we do not share it with other customers. Other organizations cannot see your projects, runs or results.
4. Our software, and what the results mean
We own the software and its methods. You may use it for your own business purposes during the pilot. You may not copy it, reverse engineer it, or use it to build a competing product, and you may not share results files in a way that gives others access to the software.
The results are probabilistic estimates. They come from a simulation of the inputs you provide and the assumptions described in the method guide. They are not guarantees of performance, an engineering certification, or professional advice, and they are only as good as the inputs. You are responsible for decisions you make using them, and for checking them against your own engineering judgment.
5. Acceptable use
Do not use the service unlawfully, try to access data that is not yours, probe or disrupt the service, or run workloads meant to overload it. The service has limits (for example on simulated years and on runs at the same time) that protect all users; do not try to get around them.
6. Confidentiality
Each of us will keep the other's non-public information confidential and use it only for the pilot, except where disclosure is required by law. Your data is your confidential information. The software, its methods and its performance are ours.
7. No warranty
The pilot service is provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free, or that results will fit a particular purpose. There is no service-level commitment during the pilot.
8. Limit of liability
To the extent the law allows, we are not liable for indirect, consequential or lost-profit losses, and our total liability to you for anything arising from the pilot is limited to [limit on our liability, to be set with a lawyer]. Nothing in these terms limits liability that cannot be limited by law.
9. Ending the pilot; deleting your data
Either of us may end your use of the service at any time. On request after the pilot ends, we will delete your organization's data from the live service (copies in backups expire on the backup schedule described in our privacy notice). You can export your projects and workbooks at any time.
10. Changes, law and contact
We may update these terms; we will tell you before a material change applies to you. These terms are governed by the laws of [state or country whose law governs these terms]. Questions: contact@ninefirm.com.
